TERMS OF SERVICE

REGISTRATION

  • Class confirmations will be emailed only at least three days prior to the start of the session to the email address provided on your child’s registration form.

  • Classes are held on your child’s school campus unless otherwise noted.

  • Late registrations are accepted on a space available basis and with the permission of the instructor. 

  • Once a class is filled to capacity, registrants will be placed on a waitlist.  If a space becomes available, registrants will be notified by email and have 1 business day to respond and pay for their space in the class. If no response is received, the space in the class will be offered to the next person on the waitlist.

  • Please do not send your child to a class if the registration form and payment have not been submitted.

PAYMENT

  • ​Full payment is required at the time of registration.

  • There is a $30 fee for all returned checks.

  • Class fees are NOT pro-rated/discounted after the beginning of the scheduled session

REFUND

  • Once classes are established, no refunds will be given.  Classes are considered established fourteen days prior to the start of the session, and will be confirmed by email three days before the start of the class.

  • No partial refunds or make-ups for missed classes.

  • Registrations are subject to a non-refundable fee of $20.  

  • Credit (less a $10 administrative fee) may be requested when a withdrawal/exchange from a program takes place prior to the 14-day cancellation deadline, subject to approval.

  • Refunds/credits must be requested no later than 14 days prior to the programs start date. No refunds/credits will be given if requested after the 14-day deadline.

  • Some programs may have special refund/credit restrictions. These restrictions will be stated in program descriptions.

  • Refund/Credit requests must be made by in writing.

  • Full refunds will be given for classes cancelled by Electivity.

PICK UP

  • Students will be dismissed according to dismissal instructions submitted on the registration form.

  • Students will be checked into the school's Extended Care program if parents arrive 5 minutes after the program ends.

  • A late fee of $10.00 per each 5 minutes of lateness will be assessed for late pick-ups.

CLASS SIZE

  • To ensure program quality for all participants, class sizes are limited according to  class description.  We strictly adhere to class size limits as stipulated by providers, and classes do fill. Please register early for your first choice.

  • For safety and liability reasons, parents, un-enrolled students or other visitors are not permitted to attend classes. 

PROVISIONS AND CONDITIONS OF ENROLLMENT

  • For the safety of the children, if a child is unfamiliar with the campus, we ask that parents accompany their child or make arrangements to have a trusted individual bring their child to the proper class location.

  • Electivity and providers are not responsible for your child’s attendance in his/her enrichment class.

  • Students are expected to act in a manner appropriate for a school environment. School rules apply. Inappropriate behavior will be discussed with the parent and may result in dismissal from class without a refund. The provider’s decision to dismiss a child shall be final.

RAINOUT/FORCE-MAJEURE

  • For activities held outdoors, rain does not cancel. Decision to cancel the class is up to the instructor's discretion. 

  • Should a class (indoor and outdoor) be cancelled due to an unforeseen cancellation or inclement weather, every effort will be made to contact families as soon as we are aware of the cancellation. Instructors will use their best endeavors to offer make up classes, dependent on the instructors' availability. No refunds will be offered.  

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19.  The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. Electivity LLC cannot guarantee that you or your child(ren) will not become infected with COVID-19. By enrolling my child(ren), I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Electivity enrichment programs and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance or participation in Electivity programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Electivity, its providers, participants of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Electivity, its agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Electivity program.

PRIVACY POLICY Electivity is committed to protecting you and your child’s privacy. The federal Children's Online Privacy Protection Act (COPPA) requires that we inform you of our practices with regards to our collection, use, or disclosure of personal information from children under the age of 13 (“child” or “children"), and to obtain verifiable parental consent prior to collecting, using, or disclosing any such information. ​ This Privacy Policy applies to parents who register their child for classes, in-person or online (“Services”), on the website, www.electivitykids.com (“Website”). Electivity does not allow children to register for our Services or use Website without the consent of a parent. By accessing or using our Website, you signify that you have read, understood and agree to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. 1. Collected Data: When you interact with us through the Website, we may collect information that, alone or in combination could be used to identify you (“Personal Data“) and other information from you. We collect Personal Data from you when you voluntarily provide such information, such as when you contact us with inquiries or register for our Services. We may collect the following information (including but not limited to) from you in order to provide our Services: Name Email address Phone number Zip code or city and state you are located in Your child’s name Your child’s age or birthday or grade Your child’s school Your child’s teacher and classroom Your child’s allergies and other information Video recordings of your child during classes By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Policy. If you provide Personal Data to our Services, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of Electivity and the authorized third parties referred to herein. 2. Use and Disclosure: Electivity shares the date collected above and any notes Parents have provided about their Child to the Class Teacher, in order to allow the Teacher to provide Classes. This information shall also be treated as part of the Parent’s Personal Data and may be shared as described in the Disclosure section above for business transfers; to vendors and service providers; and to comply with legal requirements. Electivity class sessions may take place over online videos in which video images and audio of the Children are recorded. No information is collected directly from Children until they are in the course session. Children cannot post personal data publicly on the Electivity Services. ​ While Electivity expects Teachers and all other Users to abide by our standards of conduct, please note that we cannot control or monitor what personal information your Child shares with Teachers or other classmates, nor what those third parties ultimately do with that information, and we disclaim all responsibility in that regard. 3. Passively Collected Data: When Parents use our Website, certain information may automatically be collected by third parties: IP address or mobile identifier, the type of computer operating system, the web browser, the frequency with which the user visits various parts of our sites or applications, and information regarding the online or mobile service provider. This information is collected using technologies such as cookies. ​ This data is primarily collected and shared with third parties for internal purposes, in order to: report, in aggregate how our visitors find and use our Website understand overall visitor behavior inform how we update and improve our Website We may disclose a child’s personal information if permitted or required by law, for example, in response to a court order or a subpoena. ​ We generally do not collect personal information from a child until we have received verifiable parental consent in accordance with COPPA. There are limited instances where we may collect information without parental consent in compliance with COPPA, including: An email address is collected at the time of registration, solely to contact the child's parent in order to obtain the necessary parental consent To protect the security or integrity of our sites, applications, and other technology
 ​ Information collected is not used to target advertising to specific users. ​ For any questions about how we or any third-party uses your data, please do not hesitate to contact us. Parental Rights and Responsibilities: At any time, a parent can review or ask us to delete a child's personal information, or can refuse to permit its further collection or use, by contacting us by any of the means listed in item #5 below.
